As a company, Apta Herbals LLC  is committed to protecting our customer’s personal information and privacy. The following explains our Privacy Policies.  Apta Herbals LLC is the distributor of Ohria Ayurveda’s product in the US.

Importantly, by accessing us.ohriaayurveda.com or www.ohriaayurveda.com in the USA region (“our Website” or “the Website”), you are accepting the practices described in these policies.  We are unable to modify these policies from user to user, and as a result – if you do not agree with our Privacy Policies, you are not authorized to (and should not) use our website. If you have any questions about our Privacy or any of our other company policies, please feel to contact us at wecare@ohriaayurveda.com

 

HERE IS THE INFORMATION THAT WE COLLECT  

We want to be transparent and have assembled the following information to explain the types of information we do or may collect, why we collect it, how we use it, and how we protect it. 

In general, we may collect and use personal information that identifies or relates to you or your household. In some cases, even if the information doesn’t specifically identify you (or your household) by name, you should assume that a reasonable person, with access to this same information, may be capable of associating or linking this information, directly or indirectly, to you or your household.

The reason that we collect this personal information is to provide you with our products or services, or to cause you to consider the purchase or use of our products or services. If you do not provide us with this or any other requested or required information, it may delay, prevent, hinder or limit our ability to provide, or to offer and/or advertise our products and services to you. We also use this information to process and fulfill any actual orders or requests received, and to notify (or to communicate with) you about the status of any specific order or request.  

We want to understand your interest in and/or actual shopping habits for our products and services and also, your interest in and/or actual or general shopping or browsing habits online. In doing so, we feel that we are better able to improve our actual or potential customers’ ability to find us, our products, or our Website – and to be able to offer a more streamlined, focused pleasurable, professional and up-to-date shopping or user experience. To make this possible, we commonly use the tools and/or information that is available through Google; specifically, we use Google properties including, but not limited to, Google Analytics, Google Webmaster Tools, and Google Adwords.  

If you create an account on our Website that includes a unique password, please be sure to take all steps necessary to safeguard and protect your password, username and/or other personal information (so it cannot be accessed by others). If you do not take reasonable steps, you may be liable for any unauthorized use on our Website and also, have your private information used and/or become known by others. 

Additionally, know that we automatically gather certain information, statistics and history regarding your use of our Website through the use of COOKIES and other technologies. Although many web browsers allow you to refuse the use of cookies, in some cases they are necessary to access and make full use of our Website.

 

HERE IS HOW WE USE YOUR INFORMATION 

First, we want you to know that we will not share or disclose your Personal Information to anyone except as described within this Privacy Policy. We take these and all privacy matters seriously. 

Among other things, we use information collected about you or your household to fulfill orders you have placed, respond to requests that you have made, customize products or offerings that we think you or your household may be interested in, improve our Website and services, track email, comply or facilitate our compliance with legal and/or regulatory requirements, communicate or respond to you, and/or to otherwise enhance your usage and likely satisfaction when using our Website. We may also use the information to understand your shopping history with us, and/or to let you know about new products, services, or offers or promotions that we think may be of interest. 

To maintain and operate our Website and the various related features, tools, apps and/or functionality that it offers, we commonly use the products and services offered by our trusted THIRD-PARTY VENDORS. Whenever this occurs, those third-parties may be given, and/or permitted access to your information via their digital connections to our Website.  These third-parties can include, but are not limited to, credit card processing companies, Website hosting services, Shopify (and related Shopify Application (“app”) vendors), order fulfillment center(s), data analyzers and others. 

At all times, we reserve the right to disclose information when deemed necessary by us to protect our rights or the rights of others, for fraud prevention, credit risk prevention or reduction, or to prevent harm to other people or property.   

Similarly, in the event that we are required by law (through subpoena, court order, administrative or governmental order) to disclose your Personal Information, or any information in our possession, we will. 

In the event of any sale or merger of Apta Herbals, or an acquisition of Apta Herbals’s assets or business through an asset sale, assignment of assets, corporate reorganization, or otherwise, we may transfer personally identifiable and/or other Personal Information.  If this were to occur, any transferee would be similarly bound by the terms of our Privacy Policy. 

We also may aggregate any non-personally identifying information to use in improving our Website and/or business. 

If you provide us with feedback, suggestions, recommendations or rating or review comments, we may, at our discretion, choose to use that information to improve our Website and/or business. If you provide self-identifying information we will only use it to respond to your feedback, suggestion, or recommendation; we will not share your identifying information with others without your permission or unless you request it. In the case of any product reviews that you may provide, we may share (or not share, at our sole discretion,) your reviews publicly, but not in a manner that would allow a casual consumer to reasonably associate that comment/review with you or your personal identifying information. For example: if your name is Mary Smith and you write a review about our company, products or your experience with either, we may publish your review on our Website or in any of our advertising or promotional materials, attributing it publicly to “Mary S;” if you publish it with a username or alias that does not appear to include or embody an actual person’s name (e.g., “MarysMom”), we may publish and attribute the comment or review with the alias or username.  

Comments that you post on public forums such as social media websites (like Facebook, Instagram, etc.), blogs, message boards, or other’s websites (e.g., Amazon) may, for all we know, contain the identifying information that you provided to those other social media or third-party sites. Apta Herbals and Ohria Ayurveda is not responsible for and/or does not control or monitor the websites or services offered by Facebook, Instagram, Amazon, or any other website other than our Website. 

In many cases, our customers buy gifts for others on our Website. In other instances, visitors to or customers of our Website may refer someone else to our Website or our social media accounts.  When either of these situations occur, we may ask for the gifted recipient’s or referred parties name, shipping address, phone number, email address, etc. Apta Herbals / Ohria Ayurveda US online will store and use this information for the purposes contemplated by the actual gift-giving or the potential new customer referral event. Persons or households who received or are intended to receive a gift, or those who were referred to Apta Herbals / Ohria Ayurveda US by others, can contact Apta Herbals / Ohria Ayurveda US at any time to request that we remove their personal information for our database. 

 

TEXT MARKETING AND NOTIFICATIONS  

Like many companies, Apta Herbals / Ohria Ayurveda US has seen a recent growth of interest from many consumers to use and/or receive SMS (“text”) messages to communicate with us. As a result, Apta Herbals / Ohria Ayurveda US Stores may offer customers or visitors to our Website with an option to receive and/or sent text messages from or to us. 

Before sending a SMS text to anybody, Apta Herbals / Ohria Ayurveda US Stores will seek the permission of the person who the text will be sent to through opt-ins. If you have authorized Apta Herbals / Ohria Ayurveda US Stores to communicate with you via text message, know that by entering your phone number in our checkout screen (when making purchases), or when adding your phone number to your personal profile account on our Website, or when subscribing via our subscription form, you opt-in and agree that we may send text messages regarding any orders, abandoned orders, shipping status, other matters related to a specific order, and/or general marketing offers. Unless you have both authorized our use of text message communication and have actually placed more than 10 orders in a given month, you will never receive more than 20 text messages from us in a given month. 

If you wish to OPT OUT and unsubscribe from receiving further text messages of any kind from us, reply with STOP to any mobile message that we have sent, or use any unsubscribe link provided. You understand and agree that alternative methods of opting out, such as using alternative words or phrases in a text response by you will not be recognized by our text messaging software, and will not result in accomplishing your intent to opt out of and rescind your authorization for us to use text messaging.

This Privacy Policy describes the personal information we collect whenever you visit our Website, how we use that information, your rights and choices, and the other privacy and information practices that we use (and that apply to your) use of our Website. If you subscribe to our Website, add your name and information to any email list maintained or collected on the Website, or make any purchase on our Website, you explicitly consent to this Privacy Policy. 

This Privacy Policy only covers your direct relationship with Apta Herbals / Ohria Ayurveda US Stores. Please know that it specifically does NOT cover any information collected about or from you at independently owned stores or retailers who happen to sell Apta Herbals / Ohria Ayurveda US Stores products, or on any website other than our Website.  Third-party websites, stores or entities all have their own privacy policies and we do not monitor and are not aware of those policies; and they are NOT governed by this Privacy Policy.  As a result, we are neither responsible for the content on any third-parties store, digital service or website, nor do we control the privacy practices of any third-party.  Other companies and website can and do collect and treat information differently.  We take privacy seriously, and encourage anybody who goes online, shops by mail order or walks into a store or service provider, whether they sell, discuss or promote Ohria Ayurveda-branded products or not, to carefully read and consider the privacy policies of those online sites and product/service establishments. 

Without your consent, rest assured that Apta Herbals / Ohria Ayurveda US Stores will never use your personal information for a purpose that is materially different than what is disclosed in this Privacy Policy. 

 

DO WE SELL YOUR PERSONAL INFORMATION? 

Apta Herbals / Ohria Ayurveda US Stores does not sell your personal information. 

 

UNSUBSCRIBE OR OPT OUT OF EMAIL MARKETING 

If you submit an email address to any of our mailing lists, we will use it solely for the purpose of sending your special offers and notices, and/or to communicate with you about a past or current order, or your account.  Emails sent by us will include information on how you can unsubscribe from our lists. 

We only want to send emails to people who actually want them. In addition to the opt-out instructions included in the footer of any email received, please feel free to contact us at wecare@ohriaayurveda.com, and we will help you get your email address removed or changed. 

 

HOW LONG DO WE KEEP YOUR INFORMATION? 

As outlined in the sections entitled “How do we use your information?” – personal information is kept and used for a variety of reasons.  In general, we keep information for as long as needed to support the uses described in that section, or as otherwise needed to comply with applicable State or Federal law.   

When your information is no longer needed, or when you indicate that you no longer want us to contact you (and state or federal law allows us to do so), we will safely delete your information from our records.

  

HOW WE PROTECT YOUR INFORMATION 

All of us are or should be concerned about data privacy. The news is constantly reporting instances where companies and governments are hacked. We take our own data privacy, as well as that of our customers and the Website visitors seriously. 

To keep your personal and confidential information protected, we follow reasonable technical guidelines and policies.  In many cases, those policies and protections have been put into place or mandated by partners that are much more sophisticated than we are; examples would be credit card processing companies and Shopify (whose software drives ours and many thousands of other websites).  We, and we think any reasonable person would say that those third-party safeguards and internal controls are sophisticated, up-to-date and generally effective. 

In addition, we take our own steps. These include encryption of your credit card numbers and personal information using secure socket layer (“SSL”) technology. In a nutshell, this technology provides secure, encrypted transmission of your information from your computer or phone device to our servers.  We also limit access to your personal information to only those employees and third-party vendors who need access in order to operate the Website. 

The reality is that while we work hard to protect and keep your private information private, no computer system or set of policies is 100% secure. If we become aware that our systems have become breached, we will contact you.

CHILDREN UNDER THE AGE OF 13  

We understand and appreciate how important it is to protect our children.  While our site and business is not geared or intended for children under 13, it is always possible that an unsupervised child may be able to access our Website. As a result, we have adopted specific policies designed to protect children. 

Importantly, we do not knowingly collect or store information from anybody under the age of 13.   

If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. If you have knowledge of, or any reason to suspect that we may have collected information from a child under 13, please contact us immediately at wecare@ohriaayurveda.com. 

If you are under 13 years old, do not:   

1. use our Website; or  
2. use any interactive component of our Website or Social Media accounts to post public comments about yourself; or 
3. provide us with any information about yourself (including your name, address, phone, email address, social media accounts (including any names, accounts or other names (“aliases”) that you use). 

 

DO NOT TRACK 

Like many companies, our systems are not presently capable of responding to, or acting on any “do not track” requests from browsers. 

 

LINKS TO OTHER  WEBSITES 

Our Website may contain links to other websites that are not operated by Apta Herbals / Ohria Ayurveda US Stores.  An example might be a link to FedEX, so a user can track a shipment. 

If you click on a third-party link, you will be directly to that third-parties site.  

Apta Herbals / Ohria Ayurveda US Stores does not control, and is not responsible for the content, practices or privacy policies of any third-party websites or companies.

Information Collected Through Third-Parties 

Increasingly, Apta Herbals / Ohria Ayurveda US Stores is entering into agreements with other third-parties. Those agreements often involve obtaining consumer data that is provided by other retailers. Sometimes, these agreements involve or make use of automatic data collection technologies to collect information about your equipment (e.g., are you browsing from a phone or computer), your browsing and purchasing habits or patterns, your personal information, your frequency or levels of purchases, items you have purchased, and/or other information relating to your online or shopping history.  Any and all information provided is subject to the confidentiality requirements of the disclosing third-party and also, subject to all applicable laws relating to this Privacy Policy.

Third-Party Payment Services 

In order to offer multiple payment options, Apta Herbals / Ohria Ayurveda US Stores has established business relationships with a number of third-party payment companies.  Examples include but are not limited to: PayPal, Amazon Pay, and the various credit card companies that we accept at checkout. 

If you actually make a purchase from our Website, your personal information will be collected and stored by the third-party payment service.   

Apta Herbals / Ohria Ayurveda US Stores does not control the practices, policies or privacy policies of any third-party payment company and, as it relates to your payment processing, you will be subject to the third-party’s privacy policy (and not Apta Herbals / Ohria Ayurveda US Stores Privacy Policy). 

Apta Herbals / Ohria Ayurveda US Stores is not responsible for any third-party Payment Service company’s collection, use or disclosure of your personal information.

CONSENT TO TRANSFER INFORMATION TO THE UNITED STATES 

Our Website is operated in the United States. If you are located in the European Union, Canada or elsewhere outside of the United States, any information that you provide to Apta Herbals / Ohria Ayurveda US Stores will be transferred to the United States.   

By using the Website or providing Apta Herbals / Ohria Ayurveda US Stores with information, you consent to this transfer. 

 

NOTICE TO CALIFORNIA RESIDENTS 

If you are a California resident, you have expanded rights. 

Specifically, the California Consumer Privacy Act (“CCPA”) gives you certain rights relative to the privacy of your personal information.  You have the right to request that Apta Herbals / Ohria Ayurveda US Stores deletes all of the personal information that it has collected.  You also have the right to demand that Apta Herbals / Ohria Ayurveda US Stores disclose what personal information it has, in a list of the categories of information that we have, the categories of sources from which we have collected it, the purpose for collecting or selling the information, and the categories of third-parties to whom we have disclosed or sold that information to during the preceding 12 months.  You also have the right to not be treated by Apta Herbals / Ohria Ayurveda US Stores in a discriminatory manner because you have exercised the privacy rights granted to you by the CCPA law.  You can make these requests to us up to two times in a 12-month period, subject to the limitations described within the CCPA.

As provided for in the CCPA, once received, Apta Herbals / Ohria Ayurveda US Stores will acknowledge receipt of your “Request to Know” or your “Request to Delete” within 10 business days, and if we do not grant or deny the request within that time, we will provide information about how we will process the request and what additional information will be required in order to verify your identity. We will respond to a Request to Know or a Request to Delete within 45 calendar days, although we can extend that time for up to 90 calendar days if we provide you notice and the reason it will take more than 45 days to respond. We are not required to respond to more than two Requests to Know or Requests to Delete from a consumer within a 12-month period. 

Under the CCPA, we are required to verify your identity before disclosing personal information in response to a Request to Know or a Request to Delete, and once that process is completed, we are required to obtain separate confirmation that you wish Apta Herbals / Ohria Ayurveda US Stores to delete your personal information. If possible, and consistent with the sensitivity of the personal information we possess, we will attempt to verify your identity using information about you that you have previously provided to Apta Herbals / Ohria Ayurveda US Stores. If you have a password-protected account on our Website, we will use our existing authentication practices for the account, unless we suspect fraud or believe the sensitivity of the information to be disclosed requires a more robust verification procedure. The verification procedure will vary depending on the sensitivity of the information being requested. 

You may also designate an authorized agent to make a Request to Know or a Request to Delete under the CCPA on your behalf by submitting either a power of attorney form under California Probate Code 4000 - 4465, or by submitting reasonable documentation of your identity and your written permission for the agent to act on your behalf.

We may modify or amend this Privacy Notice from time to time at our discretion. When we make changes to this notice, we will amend the revision date at the bottom of this page and such modified or amended privacy notice shall be effective as to you and your information as of that revision date.
